How Paternity Is Established in Missouri

Missouri law provides three main pathways for establishing legal paternity. The right approach depends on whether both parents agree, whether the state is involved, and how quickly the matter needs to be resolved.

Voluntary Acknowledgment of Paternity

When both parents agree, the simplest route is a Voluntary Acknowledgment of Paternity (VAP), a signed Affidavit Acknowledging Paternity that can be completed at the hospital at birth or later through the Missouri Department of Health and Senior Services Bureau of Vital Records. A signed acknowledgment carries the legal effect of a court order. Either party may rescind it without cause within 60 days of the last signature, or before the date of any administrative or judicial proceeding to establish support, whichever comes first. After that window closes, the acknowledgment can only be challenged in court by demonstrating fraud, duress, or material mistake of fact, which is a significantly higher standard.

Administrative Action Through the Missouri Family Support Division

The Missouri Family Support Division (FSD) can arrange genetic testing and issue an Administrative Order of Paternity without requiring a court appearance. This route is most commonly used when child support enforcement is the primary concern, and the state may also initiate a paternity action on behalf of the custodial parent through this process.
